One crucial difference between open market and government solutions to determine if an idea works is, if the idea does not work in the open market, it will be discarded. If the idea is implemented by law, success is not the goal of the program.

What I am quite but not completely sure of is that I would support not preventing anyone from not doing what they do not want to do. However, in some situations I would not recommend such behavior.
