The pro and con of the “living constitution” position are:
Pro, it fits within the circumstances of society today as interpreted by some.
Con, it fits within the circumstances of society tomorrow as interpreted by some.
Just speculating that ultimately the Constitution will be interpreted to mean what was originally intended, or close to it because, if history is not learned, we and our children are doomed or fortunate to repeat it.
What is here today is gone tomorrow, and the next day and so on.

Maybe the most self-beneficial reconciling penance administered by/for/to humans is performed by politicians who have a blinding trust in the concept employed as preventative responsibility contained within the theory of plausible deniability. That, on judgement day penance may be translated to the language of individual responsibility and will fail the Judge's inquiry and be passed on as the administration of justice.
